Terms of Service

By accessing or using BoqCalc (boqcalc.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform.

BoqCalc is an AI-powered construction cost estimation platform. Users upload Bill of Quantities (BOQ) documents, and the platform generates cost estimates either through a fast automated pass (Express) or a guided wizard process. The service includes document parsing, AI-suggested pricing for labor, equipment, and materials, risk analysis, and export capabilities.

You must create an account to use BoqCalc. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration. You agree to notify us immediately of any unauthorized use of your account.

BoqCalc uses a credit-based system. Credits are purchased in packs and consumed when you finalize a calculation or use certain other paid tools (such as Re-price/Indexation — see "Re-pricing, Indexation & Other Add-On Tools" below). For finalizing a full calculation, the number of credits required is determined by the AI based on the estimated project value; other paid actions use a fixed or formula-based credit cost, always shown to you before you confirm. New accounts receive 4 free credits.

All payments are processed by LemonSqueezy, which acts as the merchant of record. Prices are displayed in Euros (€). By making a purchase, you agree to LemonSqueezy's terms of service.

Credits do not expire. Credits are non-transferable between accounts.

Refund Policy: If you are a consumer in the EU/EEA, you have a statutory 14-day right of withdrawal. Unused credits can be refunded in full within 14 days of purchase — just contact [email protected]. By finalizing a calculation, running a re-pricing, or confirming any other action that consumes credits, you expressly request the immediate performance of a digital service and acknowledge that the credits consumed by that action are non-refundable once it completes. Outside the 14-day window, refunds of unused credits are at our discretion and handled case-by-case.

You agree not to: use the platform for any unlawful purpose; upload documents containing malicious code; attempt to reverse-engineer the AI models or pricing algorithms; share your account with unauthorized users; use automated tools to access the service; interfere with the platform's operation or security. If your documents or data include third-party materials such as subcontractor quotes, supplier price lists, or other confidential third-party information, you additionally warrant that you are authorized to submit that content to BoqCalc for processing — including AI-assisted analysis, re-pricing, or indexation — and that doing so does not breach any confidentiality or contractual obligation you owe to that third party. You agree to indemnify BoqCalc against any claim arising from third-party content you submit.

You retain all rights to the documents you upload and the data you enter. You grant BoqCalc a limited license to process your documents and data solely for the purpose of providing the estimation service. The BoqCalc platform, including its design, code, AI pipeline, and algorithms, remains our intellectual property.

BoqCalc provides AI-assisted cost estimations intended to support your decision-making. These estimates are not a substitute for professional judgment. All suggestions for labor, equipment, materials, and pricing are generated by AI models and should be reviewed and verified by qualified professionals before use in bids, contracts, or financial decisions. BoqCalc does not guarantee the accuracy, completeness, or suitability of any estimate for any particular project.

To the maximum extent permitted by applicable law, BoqCalc and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the platform or reliance on AI-generated estimates. Our total liability shall not exceed the amount you paid in credits during the twelve months preceding the claim.

We strive to keep BoqCalc available at all times but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience downtime. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice. Some tools are labeled "Beta" or "Early Access." These are provided on an as-is basis, may be changed, limited, or discontinued at any time without notice, and remain subject to the AI-Generated Estimates disclaimer above — the label itself does not expand or reduce any other right or limitation in these Terms.

You may delete your account at any time. We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the platform ceases immediately. Unused credits may be forfeited upon termination for cause.

We may update these Terms of Service from time to time. Significant changes will be communicated via the platform or email. Continued use of BoqCalc after changes constitutes acceptance of the revised terms.

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or your use of BoqCalc shall be resolved through good-faith negotiation before pursuing formal legal proceedings.

Some tools, such as Re-price/Indexation, update an existing, already-finalized calculation rather than creating a new one — running such a tool overwrites that calculation's resource prices and totals in place. We aim to keep a record of the prior values for your reference, on a best-effort basis, but restoring a calculation to a state before you ran such a tool may require contacting [email protected] rather than being available directly in the app, and we do not guarantee that a prior state remains available indefinitely.

Some figures produced by these tools are not independently generated by an AI model but are instead calculated or estimated from other AI-researched data already produced during the same run — for example, an estimated adjustment to a subcontractor's price or to overhead costs, derived from movement observed in directly-researched material, labor, or equipment prices. Such derived figures are clearly labeled as estimates in the app and carry the same disclaimer as AI-generated estimates under "AI-Generated Estimates — Disclaimer" above — they are not a new quote, a new AI lookup, or a re-verification of any third party's pricing, and must be independently verified before use.

A repricing or indexation run may not find a reliable market rate for every item. If a reliable rate cannot be found for at least half of a calculation's items, the run does not proceed and nothing is charged. Where a run does proceed, items for which no rate could be found simply keep their existing value, the run is considered complete, and the credits charged for it are non-refundable — even though not every single item's price could be updated.
